Facts:
Following the running of Race # 2 the SKY CITY CASINO QUEENSTOWN an information was filed by Stipendiary Steward Mr M Davidson, against Licensed Senior Jockey Ms K Williams alleging a breach of Rule 340 in that...Ms K Williams misconducted herself by using offensive language at the start prior to the start of Race # 2...
Ms Williams was present at the hearing and indicated she admitted the charge.
Mr Davidson stated that Ms Williams was riding Tappy’s Best. When the horse was loaded into the starting gate it became fractious and got its leg caste in the barrier. Ms Williams had asked for assistance from the starter's assistant but became frustrated when that assistance did not come. She then resorted to foul language which was directed at the starter's assistant. Her use of that language was picked up by the Trackside audio and transmitted live on Trackside. He said he had received several complaints from the public concerning Ms Williams' language. Mr Davidson played the video of the incident and Ms Williams could be clearly heard using the foul language.
Ms Williams stated her horse was normally good to stand in the starting gate. However, he became fractious and then got his leg stuck in the gate. He starting panicking and in doing so she got her leg caught between the horse and the gate. She had asked the starter's assistant for help but they did not respond, which she thought was surprising considering the starter's assistant had ridden in races. She had lost control in the heat of the moment.
Submissions for Penalty:
Mr Davidson said Ms Williams had an excellent record and had no previous charges under the Rule. Unfortunately her comments had been transmitted nationally on Trackside and they had received complaints from the public. He submitted a fine of between $250 and $300.
Ms Williams made no specific submissions on penalty.
Reasons for Penalty:
We have a certain amount of sympathy towards Ms Williams, particularly the circumstances in which she found herself when seeking assistance. However, the use of the language is a Breach of the Rule. The committee has taken into account Ms Williams' guilty plea, her excellent record and her conduct during the hearing. After taking all these factors into consideration we believe a fine at the lower end of the scale is appropriate.
