We find that Robin Charles was denied a fair start and recommend to the Stewards that Robin Charles be late scratched from this event.
Facts:
Following the running of race 8 the AB Lime/Ted Winslow Memorial Handicap Stewards lodged a information Requesting a Ruling “…to ascertain whether Robin Charles was denied a fair start”
Rule 632 (1) reads:
If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter.
Mr Tidmarsh, with the use of the video replays, said Robin Charles had drawn the outside barrier stall (8). Robin Charles was fractious in the stall and reared high on several occasions prior to the gates opening. He stated that the starter's assistant was holding onto the ear of Robin Charles during that time. As the gates opened Robin Charles was already starting to rear again and was being held by the starter's assistant. However, on this occasion the starter's assistant continued to hold the horse's ear and as a result Mr Cuneen dismounted and the horse left the stall rider-less. Stewards were requesting a ruling as to whether Robin Charles was denied a fair start and should be late scratched.

Mr Cuneen stated that Robin Charles was more fractious than usual in the stall. The horse had reared high on several occasions and when the gates opened he was already rearing again and being held by the starter’s assistant. As a result he was forced to dismount.
Mr Price stated he had four horses on the barrier list for race 8. He had loaded Robin Charles first and was aware that the horse had reared very high on several occasions while other runners were being loaded. He had called out to the assistant prior to the start but was unsighted. He stated the assistant had to decide whether to hold on or let go of the horse and anticipate the gates opening.
Reasons for Decision:
After viewing the relevant videos and hearing evidence from all the parties the committee has to decide if Robin Charles was denied a fair start, through the actions of the starter’s assistant or, be declared a runner due to its wayward barrier manners. Robin Charles had been on the barrier list for several starts and became fractious when loaded into the stall. The starter had noticed the horse had reared several times while being held by the starter’s assistant. As the gates opened the horse was already starting to rear and continued to be held by the starter's assistant which ultimately led to Mr Cuneen dismounting.
