Facts:
Mr Munro alleged that Mr Telfer (PRINCE RANIER) shifted inwards racing into the first bend forcing JERRY GARCIA inwards resulting in TOP POCKET CHANCE being checked, with that horse breaking as a consequence.
Mr Renault demonstrated on the videos that Mr Telfer was racing 3-wide at the winning post with a lap to run when he shifted into a 2-wide position. Mr O’Reilly was racing to his inside and Mr Close was on the pylons. Both drivers were tightened, and Mr Close was checked and his horse subsequently broke.
Mr Munro said the Stewards spoke to Mr O’Reilly after the race who told them that he been yelling out to Mr Telfer to give him room.
Mr Telfer said while he admitted the breach, he believed TOP POCKET CHANCE had broken free of interference. The horse had galloped some time after he had shifted in.
Mr Telfer said he had heard yelling but that was not unusual in a race. He was not aware it was directed at him and he believed at the time that he was being pushed out by Mr O’Reilly.

Mr Munro produced Mr Telfer’s record. He has had 366 lifetime drives: 10 this season, 8 the one before, and 19 the one before that. Mr Telfer’s last drive was on 12 January when he was suspended for 4 days for careless driving causing interference.
Mr Munro said the Penalty Guide starting point for a second breach was a 3-day suspension. (A first breach is a 10-drive suspension.) When regard was had to the infrequency with which Mr Telfer drives, he said a “time-based” penalty was more appropriate in this case.
Mr Telfer said he drove principally in the Canterbury area. He had three horses in racing trim. He drove only his own horses and often he would engage outside drivers for them. He would have one or two drives at a meeting, at the most.

Mr Telfer has admitted a breach of the careless driving Rule where he has shifted from a 3 to a 2-wide position when not clear and has tightened two horses racing to his inside. TOP POCKET CHANCE, which was racing on the pylons, has galloped very shortly after the incident. That horse lost its chance in the Race.
Mr Telfer has a previous careless driving breach, which unfortunately was the drive immediately preceding this breach. He is not a busy driver.
After hearing from Mr Telfer, the Committee calculates penalty on the basis that Mr Telfer has on average one and a half drives per meeting (or 3 drives every 2 meetings). The Committee believes a 12-drive suspension is appropriate.
