As Mr Cameron admitted the breach the Committee find the charge proved.

Penalty:

We grant Mr Cameron’s request to seek a deferment to his suspension as per Rule 1106(2).

Accordingly, Mr Cameron had his license to ride in races suspended for a period to commence after racing on 7 October and conclude after racing on 14 October 2016 (4 days).

That period of suspension encompasses meetings at:

Matamata 8 October

Te Aroha 12 October

Woodville 13 October

Tauranga 14 October

Facts:

Following the running of race 3, Distinction Hamilton $5k Punters Challenge 5th November, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Coles, alleged that Mr Cameron permitted his mount INDIAN MAID to shift outwards when not sufficiently clear of ROSE IMPERIAL which was checked near the 200 metres.

Mr Cameron acknowledged that he understood the Rule and confirmed his admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Oatham demonstrated the incident using the available video footage. He identified that Mr Cameron shifted out when attempting to obtain clear racing room near the 200 metres. He said this resulted in ROSE IMPERIAL being crowded and checked. He stated that Mr Cameron was only ¾ of a length clear when the check occurred. He added that Ms Collett, the rider of ROSE IMPERIAL had to check her mount because she had nowhere to go.

Mr Cameron said the interference was clear on the video films and added that he misjudged the situation.

Submissions for Penalty:

Mr Coles produced Mr Cameron’s record which showed 2 previous breaches under this Rule in the last 12 months, the most recent being 13 December which incurred a 5 day suspension. He said this was a very good record given that Mr Cameron is a busy rider. He said the level of carelessness was at the low end and submitted a 4 day suspension.

Mr Cameron advised that he had upcoming engagements at Timaru on 7 October and sought a deferment to any proposed suspension. He asked the Committee to take into account his record and believed the interference was at the low end.

In response to a question from the Committee, Mr Cameron was forthright in that he had no intention of riding at Winton on 9 October.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. The Penalty Guide for Judicial Committees recommends that the starting point for careless riding is a 5 day suspension which is adjusted based on mitigating and aggravating factors.

The mitigating factors were Mr Cameron’s admission of the breach, the level of carelessness was assessed as low end and his very good record given his large quantity of rides. We note that it has been over 9 months since Mr Cameron rode in a careless manner. These factors clearly warranted a reduction in the penalty.

However, this has to be balanced against the fact that Mr Cameron allowed his mount to shift out about 2 horse widths when only ¾ of a length clear of Ms Collett who was checked.

The Committee recognised Mr Cameron’s honesty regarding Winton on 9 October.

After taking into account all the above factors the Committee considers an appropriate suspension was 4 days.
