Facts:
Following the running of race 3 the KB & Associates Accountants Trot, Stewards lodged a protest under r870(3) and the Breaking Horse Regulations, against the fifth placed IT’S SUMMERTIME. The Information alleged that IT’S SUMMERTIME broke from its gait about the 1300 metres mark and galloped in excess of 150 metres.
Mr Douglas represented the connections of IT’S SUMMERTIME and did not contest the Protest.

Mr Renault, with the use of the video’s, stated that IT’S SUMMERTIME broke free of interference about the 1300 metres and returned to its proper gait after approximately 260 metres. This was in excess of the allowable 150 metres. He said Miss O’Reilly made every attempt to get IT’S SUMMERTIME back to its proper gait. He sought disqualification under r1003.
