As the breach was admitted we found the charge proved.

Penalty:

After taking all of the above into consideration and under the provisions of rule 1106(2) we impose a suspension on Miss Collett from riding in races which is to start after racing on 17 March and conclude after racing on 22 March 2012 (4 days). The racedays which fall into this suspension are:

19 March-Rotorua

20 March-New Plymouth

21 March-Pukekohe

22 March-Dunedin. (As Miss Collett rode at the Dunedin meeting on 4 February and had intended riding there on 22 March we included this day in her suspension period).

Facts:

Following the running of Race 8 an information was filed by Stipendiary Steward Mr J Oatham against licensed jockey Miss N Collett alleging a breach of Rule 638(1)(d) in that she permitted her mount 'ADHIRA' to shift inwards when not clear of 'MY BYRON BAY' (R.HUTCHINGS), in turn forcing that runner to move inwards onto 'BRICK HOUSE' (M.CROPP) which was checked.

Submissions for Decision:

Mr OATHAM demonstrated the video films which showed that at around the 1200m mark in the back straight ADHIRA ridden by Miss COLLETT was 3 horses wide near the lead after beginning quite well from the 1580m starting point. As the horses neared the turn ADHIRA shifted inwards when barely a length clear of MY BYRON BAY (R.HUTCHINGS), forcing that horse to ease rather sharply, in turn putting pressure on the horse inside it, BRICK HOUSE (M.CROPP) which was checked.  ADHIRA was then two wide near the front of the field. In mitigation Mr OATHAM stated that while initially clear to move inwards on ADHIRA Miss COLLETT had caused the interference when the other runners affected had moved forward as she eased her mount.

Miss COLLETT had nothing to add when asked for an explanation.

Reasons for Decision:

The charge was proved as the breach was admitted.

Submissions for Penalty:

Mr Oatham told the committee that Miss Collett had a clear record during the past 12 months, although for part of that period she had not been race-riding. He felt that due to the mitigating circumstances mentioned that the incident fell into the lower end of the low-mid range scale.

Miss Collett stated that she had riding commitments up to and including 17 March 2012 (Te Rapa).

Reasons for Penalty:

The committee carefully considered all the evidence and submissions. We take into account that Miss Collett was to some extent a victim of the circumstances in that the horses inside her mount moved forward as she was attempting to move closer to the running rail and easing her mount.  Balancing this, Miss Collett was barely a length ahead of the horse inside her when she commenced to move inwards and the two horses inside her were affected to a varying degree, the horse nearest the running rail (BRICK HOUSE) being quite severely checked. We find that this breach is at the lower end of the scale on the range of seriousness.
