Facts:

Following the running of Race 4 (no deposit) only $80 a month trot 2200m an Information was filed by Stipendiary Steward Mr V Munro alleging Driver Mr B Barclay drove carelessly near the 500 metres when allowing his horse (Peregrine) to strike the sulky wheel of Maranatha Atlas (B Orange) resulting in this horse breaking and checking trailing runners.

Mr Barclay confirmed he understood the rule and also he re confirmed his admittance of the breach.

Rule 809 (3) (b) provides:

No driver in any race shall drive carelessly

Mr Munro asked Miss R Hayley to highlight the incident using the various video clips.

Mr Munro stated that Mr Barclay has moved down too soon and as a result has hit the sulky wheel of Maranatha Atlas who in turn has affected the chances of Kiwi Heir, The Power Broker and Emdeegee.

Mr Munro stated that Peregrine had finished the race off stoutly and the horses affected were not in contention in the race.

Mr Barclay agreed with Mr Munro’s summation.

Mr Munro told the Committee that Mr Barclay was an extremely busy southern driver who has had 7757 lifetime drives, 350 last season and 79 this season.

Mr Munro stated that Mr Barclay had admitted the breach and had an excellent driving record.

Mr Munro referred to the penalty guide stating that the starting point under this rule as $500 or a ten drive suspension.

Mr Munro submitted that he would be seeking a fine between the $200 to $250 range.

Mr Barclay had no submissions on penalty.

The penalty guide starting point for this breach is $500, the Committee has given Mr Barclay credit for the mitigating factors for his early admittance of the breach, the low end of carelessness and Mr Barclay's excellent driving record.
