Therefore, our ruling is that ‘I Lie Kit” is declared to be a non-starter.

Facts:

Following the running of Race 10, Stipendiary Steward Mr Matthew Williamson, requested a ruling with regard to an incident that took place at the starting stalls.

The information reads:

“That “I Lie Kit” was denied a fair start due to a mechanical failure.”

The request was made pursuant to Rule 632 which reads as follows:

“If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a race owing to the mechanical failure of the starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord, the Judicial Committee may declare such horse to be a non-starter.”

Video coverage of the incident was shown. The coverage showed all starting gates open with the exception of the starting gate for barrier position 2, which was the position of “I Lie Kit”.

Mr Daly, the trainer of “I Lie Kit”, stated that it was clear that the gate did not open and that he was happy for his horse to be declared a non-starter.

The jockey, KC Walters, stated that he was of the belief that his horse pushed the gate open.

After that, the horse was flat footed and took no effective part in the race, finishing either 2nd or 3rd to last.

Reasons for Decision:

The evidence before us was clear. The gate to barrier 2 did not open. There was a mechanical failure of the starting stalls. “I Lie Kit” did not finish in the first three placings.
