Facts:
Mr Edge was charged by the Stewards for using his whip while having one foot out of the footrest in race 1 the Bishopdale & Bush Inn TABS Amateur Drivers Mobile Pace. The Stewards alleged that inside the final 300m Mr Edge was seen to strike his horse several times with the whip, with one foot not in the footrest which was a breach of ”… clause (k) of the Whip Regulations”
Rule 869 (2) reads:
No horseman shall during any race use a whip in a manner in contravention of the Whip Regulations made by the board.
Whip Regulation (k) reads:
No horseman is permitted to use the whip when their foot is free of the sulky footrest (in conjunction with Rule 867)
Mr Edge admitted the charge and appeared at the hearing.
Mr Munro, with the use of the video replay, showed Mr Edge (RUSSIAN EXPRESS), who was on the extreme outside of the track, drop his right foot and strike his horse seven times over a distance of 200 metres. He said this was a breach of the Whip Regulations.
Mr Edge stated that when he reached down to activate the removable ear plugs his foot got caught up in the string attached to the ear plugs.

Mr Munro said it was Mr Edge’s first charge under section (k) of the Whip Regulations. He’d had 9 drives this season, 30 last season and 147 lifetime. He had a previous use of whip charge (b) in September last year. He sought a fine of $300.
Mr Edge said he would prefer a fine as opposed to a suspension.
