Mr Goodwin used the films available for the committee to view where prior to the 200 metres, Mr Parkes used his whip in an excessive manner, which is outside the guidelines. Mr Parkes has used the whip successively 11 times.
Mr Parkes in admitting the breach stated that his mount loomed up to win the race but once in front, it pricked it’s ears and relaxed, hence the reason for using the whip, but did not mean to use it in that manner and had tried just too hard.
Submissions for Penalty:
Mr Goodwin believed it was a momentary lapse of judgement by Mr Parkes. He has a lot of rides and does not often transgress and has a clean record. The penalties of late have been in the region of $150.
Mr Parkes had no comment to make.

Having heard the evidence presented, the committee has taken into account the early plea by Mr Parkes and his clear record for a busy rider. Aggravating features were,11 consecutive strikes which is outside the guidelines. With a starting point of $300 and using recent penalties of similar degrees, the committee imposes a fine.
