Mr Oatham sought a ruling as to whether the horse NO QUANTUM was denied a fair start in Race 4.
Submissions for Decision:
Mr Oatham demonstrated on 2 video angles that the head of NO QUANTUM was being held by a starter’s assistant at the time the gates opened. The horse was very slow away as a result.
Mr Mudhoo, the rider of NO QUANTUM stated that the horse had been restless before the start and he had the assistance of a starter’s attendant who was steadying the horse. He could see on the videos that that person was still holding on to the head of the horse when the gates opened.
The Starter, Mr Price, agreed that the videos showed that the head of NO QUANTUM was being held when the gates opened.
Reasons for Decision:
The video replays of the start show that the head of NO QUANTUM was being held by a starter’s assistant at the time the gates opened. The horse was unbalanced and can be seen to be lifting its head to free the assistant’s grasp at this time. As a result the horse lost considerable ground and its chance in the race.
