Mr Bennett was charged with breaching the Push Out Rule - 869 (4) (6) (b) (c), in race 5 when he shifted CARTER outwards forcing THE RHYTHM OF LIFE wider on the track with 1100 metres to run.
Mr Bennett admitted the charge.
Mr McIntyre, with the aid of the videos, said CARTER was four deep on the running line prior to the incident. He said Mr Bennett shifted outwards forcing THE RHYTHM OF LIFE wide and improving CARTER’S position. He said CARTER had gained an advantage which it was not entitled to.
Mr Bennett stated he believed THE RHYTHM OF LIFE wasn’t travelling that well and had started to drift. He was not aware the Push Out Rule had changed.

Mr Munro stated Mr Bennett was an owner/driver who had come back into the industry after a long absence. He had had four drives this season. He sought a five drive suspension or a fine of $250 for a first offence.
Mr Bennett said he intended starting his horse at Cromwell on the 6th January.

Mr Bennett admitted the breach and has an excellent record. A fine is appropriate in the instance.
