Facts:
Following the running of Race 1 (Welcome to Manawatu Raceway New Season Handicap Trot 2500m), Information A2343 was filed with the Judicial Committee. It alleged a breach of Rule 870(3) and the Breaking Horses Regulations stating: "...That RARANGI OPAL broke in excess of 50 metres in the final 200m".
The provisional placings were:
1st - (6) MAJESTIC STRIDE
2nd - (5) PEEP O DAY
3rd - (4) T A's CRACKER
4th - (3) RARANGI OPAL
Rule 870(3) states: "Any horse which breaks from its gait shall promptly regain its proper gait."
The relevant Breaking Horses Regulation states: "(b) Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait."
Mr Abernethy was present at the hearing and had also endorsed the Information with "I do not contest the Protest".

Using the head-on and side-on films, Mr Muirhead identified RARANGI OPAL racing down the home straight. Approaching the 60 metre pylon, the horse was observed to break, free from interference for a distance of 60 metres. Mr Abernethy confirmed that his horse had broken in excess of the 50 metres, concurring with Mr Muirhead that it was for a distance of approximately 60 metres.
Reasons for Decision:
The films clearly established that RARANGI OPAL broke at the 60 metre pylon, whilst racing free from interference. This is also supported by the acceptance of the distance by the horse's driver, Mr Abernethy. Having failed to regain it's gait, RARANGI OPAL is in direct breach of Rule 870(3) and the Breaking Horses Regulations.
