As Mr Mudhoo admitted the breach it is found proved.

Facts:
Following the running of Race 8, the Wingatui Function Centre 1600, Stewards lodged an information alleging Mr R Mudhoo breached rule 638(1) (d) – careless riding- in that he “…permitted his mount Mr Intelligence to shift outwards passing the 250 metres causing Raise You Five (J Lowry) to check.”
Rule 638 (1) (d) reads:
A Rider shall not ride a horse in a manner which the Judicial Committee consider to be
(d) careless.
Mr Mudhoo admitted the charge and appeared at the hearing. He was assisted by Mr D Walsh.
Mr McLaughlin, with the aid of the videos, stated MR INTELLIGENCE was trailing the leading runners about 300m out from the finish. Mr Mudhoo shifted outwards sharply to secure a run and in doing so shifted onto RAISE YOU FIVE. Mr Lowry was forced to take a hold and check his mount, losing ground and momentum.
Mr Mudhoo stated his outwards shift was sharp and that he got too close to Mr Lowry’s mount. He said he corrected his mount but it was too late.
Mr Walsh stated that MR INTELLIGENCE was having its second race day start and was a bit green. He said the interference was an error by both the horse and Mr Mudhoo.

Mr Davidson said Mr Mudhoo had a good riding record with no previous charges for any breach of the rules. He’d had about 100 rides and had ridden 10 winners. The breach of this rule was at the low end of the scale and while he was entitled to shift outwards he had shifted too far. He submitted a suspension was appropriate.
Mr Walsh stated Mr Mudhoo preferred to have any suspension start immediately as he would like to ride on Boxing Day (26th December). He said the interference was at the low end and due to greenness by both parties.
Reasons for Penalty:
We take a starting point of six days suspension. We have taken into account Mr Mudhoo’s admission of the breach, his excellent riding record and that the interference was at the low end of the scale, and give him credit for that. A five day suspension is the appropriate penalty.
