"Croix du Sud" is disqualified as it did not carry the correct weight in the race. The obvious implication is that the horse gained an advantage as a consequence of a lighter weight being carried.
Facts:
After the weigh-in, following the running of Race 7, the "Coupland's Bakeries Rating 80", the Clerk of the Scales informed the Stipendiary Stewards that Ms DS Johnson, the rider of "Croix du Sud" had weighed in one kilogram lighter than her carded weight. The Clerk of the Scales, had been alerted to that happening by Mr J Bridgman, the trainer of the horse in question.
The Stipendiary Stewards accordingly sought a ruling in terms of Rule 648(3) that "Croix du Sud" be disqualified.
Submissions for Decision:
Mr Ray, on behalf of the Stipendiary Stewards, submitted that as Ms Johnson could not meet the allowances provided for in the rule that the horse had to be disqualified.
By way of explanation, Mr Bridgaman told the hearing that he had three entries in the race, and that he had taken all three sets of saddles, lead bags, and saddle cloth number across to the stables to enable the horses to be saddled up. He said that there must have been a mix-up in the saddle cloth numbers and obviously, he had made a mistake. As a consequence, "Croix du Sud " did not carry the correct lead bag in the race.
Reasons for Decision:
Rule 648(3) is clear in its terms that if the weigh-in weight is lighter than the handicapped weight, and providing the various allowances to the rule are not met, then the horse shall be disqualified. None of the exceptions/allowances apply in this case and therefore disqualification is mandatory.
