FACTS
The dog TRON BRADMAN raced in in race 5 at the Waikato Greyhounds meeting at Cambridge on 24 December. He finished in 5th place, and earned $20 Stakemoney.

An Information was subsequently lodged by Stipendiary Steward, Mr G Whiterod to the effect that TRON BRADMAN was ineligible to race in that race as he was a ‘Class 2’ dog and the race was for ‘Class 1‘ dogs.

Stipendiary Steward, Ms P Kinsey informed the Committee at a hearing on 30 December 2016 that as a Class 2 dog, TRON BRADMAN was ineligible to run in that race and asked the Committee to therefore disqualify the dog from that race. TRON BRADMAN had been entered for a race on the day of this hearing and was late scratched from that race as it was also ineligible to run.

Ms Kinsey referred to an email from Mr R Moore, Assistant Racing and Administration Manager for GRNZ in which he outlined that due to an error in their systems the dog concerned had incorrectly received a penalty after a race on 20 November 2016. Mr Moore stated that GRNZ would not seek reimbursement of the $20 Stakemoney if the dog was disqualified from the subject race.

Mr Fergusson and Mr Hore were present at the hearing. They acknowledged that TRON BRADMAN should be disqualified from its 5th placing on 24 December, however they added that that they had 3 questions they wished answers to, and i.e.
    1. What happened
    2. Who was responsible
    3. Would there be compensation payable to the dogs owners.

The relevant Rule reads ‘ Any objection on the grounds of misstatement or omission in any entry or on the grounds that the greyhound which competed was not the greyhound nominated or that such greyhound was not qualified under the conditions of the race’

DECISION OF COMMITTEE
1. The dog ‘TRON BRADMAN’ is disqualified from its 5th placing at Cambridge on 24 December 2016.
2. There is no order made for repayment of any Stakemoney.
3. As this matter was heard on a raceday, there is no order made regarding costs to any party.
4. Messrs Fergusson and Hore are advised to take their concerns as above to New Zealand Greyhound Racing and/or Waikato Greyhound Racing Club. This Committee has not been appointed to hear these matters and in any event has no jurisdiction to do so.
