Following the running of Race 10, the Speights Ale House Mobile Pace, an Information Instigating a Protest was filed by Mr N G McIntyre, Stipendiary Steward.The Information read as follows:
This is a Protest by Horse number (3) placed 5th by the Judge , against Horse number (5) placed 3rd. The breaking or interference occurred: 'Near the 1100m Tommy The Tippler struck the wheel of Sorrento Bay (3) (D Dunn) resulting in the rim coming adrift'.
Submissions for Decision:
Stipendiary Steward Mr N McIntyre called for Mr D Dunn to describe the alleged incident using video film. Mr Dunn stated that at approx. the 1100m he went to go 3 wide, shortly after, his sulky wheel was punctured and the tyre gradually went flat and came off the rim. When questioned, he felt that it had affected his chance. He also stated that whilst he may have not been fully out in the 3 wide lane, his horse did not contribute to the incident. He did however admit that his horse did tend to run out during the race. He believed that contact was made in the 3 wide lane.
Mr Wallace, Stipendary Steward, who was viewing the race from the tower at the top of the straight could not confirm where the point of contact was made.
Mr Armour, in giving his explanation, stated that Mr Dunn had been (half carting) for much of the race and that he (Mr Armour) had attempted to move into the vacant space left by Mr Dunn at least 2/3 times at approximately the 1800m and that he was forced to check off the back of Mr Dunn's horse. He believed that there was sufficient space to move safely into, but when Mr Dunn was crowded by Miss Barclay (Driver of Eljoe No. 12), some tightening occurred.
Mr T Kilkelly commented that he felt that his horse had every right to move into the space vacated by Mr Dunn and that his horse's chances were ruined by Mr Dunn.
Mr Armour then stated that he felt that the fact that his horse's head had passed Mr Dunn's head and body on the inside, proved that there was sufficient space in the 2 wide line.
Mr McIntyre in summing up, used video film (front and side on) and repeated that in his opinion, the incident was the result of Mr Armour moving into a space where there was insufficient space. Mr McIntyre commented that the film was 'No Aid" as the actual point of contact could not be seen.
Committee adjourned to consider its decision.
Reasons for Decision:
The Committee carefully considered all the information presented, with particular emphasis on the accounts given by Mr Armour (Driver of Tommy The Tippler) and Mr Dunn (Junior Driver of Sorrento Bay). The Committee agreed with Mr McIntyre that the video film was of no assistance, in spite of viewing the alleged incident numerous times. The Committee felt that Mr Dunn's driving did not help the situation (continued half carting) and that the Committee was not totally satisfied that the contact was entirely the fault of Mr Armour.
