Penalty:
The committee is aware that Mrs Allpress is suspended until 2 December and accordingly we impose a suspension on Mrs Allpress from riding in races which is to start after racing on 2 December and conclude after racing on 8 December 2011 (4 days). This deferral comes pursuant to rule 1106.

Facts:
Following race 2 an information was filed pursuant to rule 638(1)(d). The informant Mr Oatham alleged that near the 250 metres Mrs Allpress allowed her mount CROWN OF THORNS to shift out when not clear of SNAVE (J McDonald) which was checked. This caused it to shift out and hamper GENDARME (C Grylls).
Submissions for Decision:
Mr Coles demonstrated the video films and pointed out to the committee CROWN OF THORNS racing in a 2 wide position at the 250 metres. Shortly after this point Mrs Allpress moved out for a run which Mr Coles described as marginal. In doing so she moved into the line of SNAVE when insufficiently clear causing Mr McDonald to check sharply. Mr Coles conceded that Mrs Allpress probably moved out further than she intended but she had kept riding forward at all times.
Mrs Allpress in admitting the breach agreed she had moved out further than she had intended but the riding was competitive at the time.

Mr Oatham said Mrs Allpress had incurred 5 suspensions in the last 12 months which was still a good record for the large number of rides she has. He submitted her carelessness on this occasion was at the low end of the scale.
Mrs Allpress confirmed to the committee she rode throughout New Zealand.
Reasons for Penalty:
The committee carefully considered all evidence and submissions. Mitigating factors are Mrs Allpress' admission of the breach and her good record. We are satisfied that her carlessness was at the low end of the scale on this occasion.
