Accordingly, Mr Prastiyou had his license to ride in races suspended for a period to commence after racing on 21 November and conclude after racing on 1 December 2017 (7 national riding days).
Facts:
Following the running of race 7, Chesters Plumbing & Bathroom Handicap, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Williamson, alleged that Mr Prastiyou allowed NATUZZI to shift in when not clear of SNAPSHOT which was hampered near the 100 metres.
Mr Prastiyou acknowledged that he understood the Rule and confirmed his admission of the breach.
Rule 638(1)(d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Coles used the available video footage to demonstrate the incident. He identified that near the 100 metres Mr Prastiyou was riding NATUZZI forward when he allowed his mount to shift in 1 to 2 horse widths. He said that Mr Prastiyou was not the required distance clear of SNAPSHOT who was inconvenienced and Mr Lammas had to stop riding his mount for 3 or 4 strides. He said the interference may have cost SNAPSHOT 4th placing.
Mr Prastiyou said that NATUZZI was under pressure at the 100 metres and he didn’t realise that Mr Lammas was racing on his inside.
Submissions for Penalty:
Mr Williamson produced Mr Prastiyou’s record which showed 3 previous breaches under this Rule in the last 12 months, the most recent being 28 October 2017. He said the interference was not great but it may have denied SNAPSHOT connections their chance of running 4th. He said the margin beaten 4th and 5th was a head and under the old Rules a protest would have been lodged. He said the onus is on a Jockey not to cause interference and described the carelessness as low range.
Mr Prastiyou advised that he had engagements at Waipa on 21 November and any proposed suspension could start after that date.

The Committee carefully considered all the evidence and submissions presented.
When reviewing the video footage the Committee observed that Mr Prastiyou allowed his mount to shift in 1 or 2 horse widths into the rightful line of SNAPSHOT when no more than 1 length clear of that runner. In doing so Mr Lammas, the rider of SNAPSHOT, was forced to take a hold of his mount for approximately 4 strides when hampered at a crucial stage in the race.
The consequence of Mr Prastiyou’s actions may well have cost SNAPSHOT 4th placing given the head margin between 4th and 5th at the finish. This potentially affected the connections of SNAPSHOT and the betting public who had invested on a First 4. Further to that we note that Mr Prastiyou went on to win the race by a head margin. Therefore, after taking into account all factors we deemed the totality of carelessness to be mid-range.
The Penalty Guide for Judicial Committees recommends that the starting point for a mid-range carelessness is 8 National riding days.
The mitigating fact was Mr Prastiyou’s admission of the breach, for this the Committee afforded Mr Prastiyou a 1 day reduction.
The Committee considered Mr Prastiyou’s record be average and a neutral factor after having regard for his quantity of rides in a 12 month period.
