Mr Newman admitted the breach and on viewing the video the charge is proved.

Penalty:

Mr Newman is suspended from the end of racing today 8 January, up to and including 27 January (3 days).

 

 

Facts:

Following the running of race 5, the Pick And Shovel Junior Drivers Trot, Stewards charged Mr Newman with a breach of rule 869(2) alleging that he used his whip in contravention of the Whip Regulations.

Rule 869 provides as follows:

(2) No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.

The Use of Whip Guidelines provide:

The whip shall not be used more than 10 times in the last 400 metres of a race, otherwise this will be deemed excessive use pursuant to these Guidelines.

Mr Newman admitted the breach and appeared at the hearing.

Mr Renault stated that Mr Newman (GIRLS LET LOOSE) was handy to the leaders on the home turn. Mr Newman was observed to use his whip approximately 12 times from about the 200m mark to short of the finish. He used his whip 10 times without a break, and a further two more times after that. There were several other strikes but they were on the tail. He said Mr Newman’s use of the whip was excessive.

Mr Newman stated he lost count in the home straight. He said was too eager to urge his horse on. He admitted it was excessive.

Mr Renault said Mr Newman was in his first season as a Junior Horseman and had had 14 drives. He had a previous charge under the rule on the 14 December (11-13 strikes) where he was fined $200. It was Mr Newman’s second charge within a short period. The breach was at the low end of the scale and he sought a suspension of 3–5 days.

Mr Newman stated he was based in the Canterbury region and was not travelling to the Nelson meetings.

Reasons for Penalty:

Mr Newman’s breach is at the lower end of the scale. However, it is his 2nd breach of the rule and a suspension is inevitable. Taking into account Mr Newman is not travelling to the Nelson district a suspension of three days in the Canterbury region is appropriate.
