As the breach was admitted we find the charge proved.

Penalty:

Accordingly we impose a suspension on Mr Nolan from riding in races which is to start after racing on 22 December and to conclude after racing on 30 December 2010 (4 riding days).

Facts:

Mr M Williamson,Stipendiary Steward, demonstrated the video films and pointed out to the committee that Mr D Nolan permitted his mount KILIFI to shift in near the 250 metres when not sufficiently clear of THE PARTY STAND (C Grylls)which was checked and forced in resulting in a check to PEACE LILY ( J McDonald).He said Mr Nolan was only ¾ length clear when he shifted in.

Mr Oatham, Stipendiary Steward, said Mr Nolan had been riding in New Zealand for 7 months and had a clear record which is very good. He said Mr Nolan was very co operative with the stewards and freely admitted he breached the rules. However he believed the interference received by 2 horses on his inner was quite significant. He submitted a 4-6 day suspension would be appropriate.

Mr Nolan submitted that he had firm commitments at Matamata on 22 December 2010.He said he was disappointed at having to miss commitments at Ellerslie on 26 December.

Reasons for Penalty:

The committee carefully considered all evidence and submissions. Mitigating factors are Mr Nolan's admission of the breach, his excellent record, co operation with stewards. The aggravating factor is the inward movement when not sufficiently clear resulting in 2 horses receiving checks. Taking the mitigating factors into account we believe the suspension can be moved down from the starting point of 5 days and the appropriate penalty is one of 4 days.
