The Committee finds that Sunnivue Phileah did not breach r869 (7B) and the protest is dismissed.

Facts:

Stewards lodged a protest against the third placed Sunnivue Phileah following Race 3. The Stewards alleged that Mr Morrison breached r869 (7B) when he shifted Sunnivue Phileah inside a marker peg approximately 150 metres from the finish and in doing so gained an advantage. Mr Morrison appeared at the hearing representing the connections of Sunnivue Phileah.

Mr McIntyre stated that on entering the home straight Sunnivue Phileah was three back on the pole line. Mr Morrison shifted Sunnivue Phileah into the Passing Lane which was available to him and had room. He said Miss K Tomlinson (Maudarchy), which was trailing the leader, shifted inwards slightly and forced Sunnivue Phileah inwards to cross the pole line. Stewards were seeking the disqualification of Sunnivue Phileah.

Mr Morrison stated Maudarchy was struggling to keep up and there was room in the Passing Lane for Sunnivue Phileah. He said Maudarchy ran inwards slightly when under pressure, which forced Sunnivue Phileah over the marker peg. 

Reasons for Decision:

Rule 869 (7B) allows a discretion if the Rule was breached due to the actions of a horse or another driver. In this instance Maudarchy shifted inwards when under pressure, which forced Sunnivue Phileah over the pole line and inside a marker peg. Prior to the incident Sunnivue Phileah had full access to the Passing Lane.
