As the respondent has admitted the breach, we find the breach proved.

Penalty:

Mr Cuneen is suspended from riding at end of the meeting at Timaru on 28 December 2017 up to and including racing on 7 January 2018. This is 10 National Days.

Facts:

Mr Davidson alleged that Mr Cuneen in race 2, the Heriot Hotel and Septic Tank Cleaners Maiden, permitted his mount DRUMSTORM to shift outwards in the final straight resulting in MUTUNGA TAP (C Johnson) being hampered and forced outwards into the line of ROC LEONE and NIGHT LADY, which was checked.

Mr Davidson stated that the charge related to the upheld protest.

Mr Tidmarsh, Stipendiary Steward, demonstrated on the videos that Mr Cuneen on DRUMSTORM was one horse width off the rails at the 200 metre mark. He showed this horse shifting wider on the track under pressure. He further showed Mr Cuneen changing the whip hand in an attempt to straighten his mount. DRUMSTORM still shifted further out on the track, hampering Mr Johnson’s mount. Mr Lowry (ROC LEONE) was shifted wider as well and as a result checked Mr Kwo (NIGHT LADY).

Mr Cuneen accepted the evidence as presented.

Submissions for Penalty:

Mr Davidson produced the respondent’s record, which showed 3 previous breaches of this rule in the past 12 months. Two of the breaches were in December last year and February of this year. However, Mr Cuneen’s recent breach, a low range, was Cup Week at Riccarton in a Group race where he received an 8 day suspension.

He stated that Mr Cuneen’s mount had been relegated from first in this race. He’d had difficulty with his mount, he did swap the whip from left to his right hand. However it appears he has had a “bob eachway” as he was still riding his mount out as it shifted out. He further stated that this charge was a mid range and a starting point of 8 National Days would be appropriate.

Mr Cuneen stated that the breach was low range as he had attempted to straighten his mount as best he could, which caused the shift and movement outwards.

Reasons for Penalty:

As a result of the upheld protest and interference, Mr Cuneen was charged with careless riding to which he admitted.

It was clear from the video’s shown that Mr Cuneen’s mount, DRUMSTORM has shifted at least 6 horse widths outwards over the final 200 metres when under pressure.

The actions of this horse have severely hampered 3 other runners.

Although Mr Cuneen swapped the whip from his left to right hand in order to straighten his mount, at no stage did he stop riding and go back to the reins to assist to straighten his horse.

The Committee regarded the breach as a mid range with a starting point of 8 National Days.

However there are some aggravating factors, being, the charge was a result of an upheld protest and a second careless riding charge in the space of two months.

We uplift the starting point by two days to 10 National Days.

Mr Cuneen asked that the suspension start at the conclusion of racing for the South Canterbury RC meeting as riders had been declared.
