Decision:

As Mr Lammas admitted the breach, the charge was found proved.

Penalty:

Taking into account all of these factors, including Mr Lammas’ upcoming riding commitments, he is suspended from the conclusion of racing on Wednesday November 30th up to and including racing on Thursday 8th December – in effect 5 days. Mr Lammas indicated that he would not be riding at Ashburton on Friday 2nd December, therefore this day was not included in the penalty.

Charge:

Following the running of Race 4, the Terry Taylor- AMP Prime Insurance Premier, an Information was lodged by Mr J Oatham alleging a breach of Rule 638(1) (d) in that C Lammas, the rider of MASIH CHIANTIK, permitted his mount to shift out over the final stages when not clear, resulting in PREPARED having to be steadied and checked.

Facts:

Mr Goodwin showed the head-on film of the home straight. He said that Mr Lammas failed to straighten his mount up when it moved outwards, causing a check to Mrs Allpress. She was forced to switch ground and take a run to his outside. Mr Lammas rode with vigour throughout and the incident resulted in a protest being lodged against him immediately following the race.

While admitting the breach Mr Lammas said that his horse was green and he thought it might have run away from the large TV screen on the inside of the track. He said that he misjudged how far out he had moved and accepted that he did not straighten in time.

Submissions for Penalty:

Mr Oatham said that Mr Lammas had an exceptional record with no careless riding charges in the previous 12 months. In the opinion of the Stewards, his carelessness was in the mid range but had resulted in relegation. He submitted that a suspension in the vicinity of 4 – 6 days was an appropriate penalty.

Mr Lammas had nothing further to add to his earlier comments, but did advise the committee that he had riding commitments at Counties on Wednesday but nothing confirmed after that day.

Reasons for Penalty:

In coming to a decision on penalty, the committee considered all of the submissions. We adopted a starting point of five days suspension. Mitigating factors for Mr Lammas were his admission of the breach and his excellent record, which would normally afford him a reduction from our starting point. In this situation however, Mr Lammas’ carelessness resulted in his horse being relegated from 2nd to 4th place which, in our opinion, was a substantial aggravating factor.
