Decision:

The protest is dismissed and the Judge's placings shall stand. In conclusion the Committee orders the payment of stakes and dividends.

Facts:

Following the running of Race 7, 100% Barrell’s 1400, an Information was filed Instigating a Protest pursuant to Rule 642(1). The Informant, Mr L Magorrian, alleged that RIVER RAIDER placed 1st by the Judge interfered with the chances of OSCAR LEGEND placed 2nd by the Judge.

The interference was alleged to have occurred in the final straight.

The Judge's placing were as follows:

1st No. 6 RIVER RAIDER
2nd No. 5 OSCAR LEGEND
3rd No. 11 LITTLE DREAMER
4th No. 1 ZACHONI

The official margin between 1st and 2nd was a head.

Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.

The Rule was read aloud and all connections present acknowledged they understood it.

Submissions for Decision:

Mr Magorrian submitted that RIVER RAIDER had pushed his mount out in the final straight. He said near the 50 metres RIVER RAIDER gave OSCAR LEGEND a slight bump which put his mount off balance.

Miss Riley submitted that Mr Dell, the rider of RIVER RAIDER, never stopped riding his mount out to the finish. She added the bump occurred before the winning post and it had affected OSCAR LEGEND because he was a big striding horse.

Mrs Logan submitted that OSCAR LEGEND was on the wrong leg entering the final straight and noted it continued to roll out. She said Mr Dell did stop riding RIVER RAIDER when it commenced to shift ground outwards in the final straight. She added that no contact occurred between the two horses when both were under a “hefty ride” and was of the view that OSCAR LEGEND had its chance to win the race.

Mr Dell submitted that OSCAR LEGEND shifted ground out in the straight when under a “hefty ride”. He believed there was no contact between his mount and OSCAR LEGEND and noted Mr Magorrian was still able to use the whip in the final straight.

Mr Williamson on behalf of the Stewards submitted it was reasonably obvious on the films that both horses shifted ground in the final straight. He said the films showed that OSCAR LEGEND shifted ground out and then in and RIVER RAIDER had shifted around. He said the contact that occurred near the final 50 metres was very minor and was of the view OSCAR LEGEND had his opportunity to go past RIVER RAIDER but was unable to do so. He added OSCAR LEGEND shifted out with RIVER RAIDER and believed OSCAR LEGEND was not dictated out. Accordingly he said the Stewards did not support the protest.

Mr Magorrian in summing up stated RIVER RAIDER had come on top off OSCAR LEGEND which meant he could not use his whip.

Mrs Logan when given the opportunity to sum up had nothing further to add.

Reasons for Decision:

The Committee carefully considered all evidence and submissions presented. All video angles were reviewed several times. At the top of the straight RIVER RAIDER was leading with OSCAR LEGEND racing directly on his outside. At the 300 metres OSCAR LEGEND ran past RIVER RAIDER and commenced to shift ground outwards. It was clear on the head – on film when both horses were ridden with vigour they both shifted ground outwards. Near the 40 metres RIVER RAIDER did slightly brush OSCAR LEGEND for about 2 strides. It is the opinion of this Committee the brush was very minimal and did not have a bearing on the outcome of the race. Accordingly there was insufficient grounds to justify an alteration to the placings.
