Facts:
Following the running of race 1, an Information instigating a protest was filed by Stipendiary Steward, Mr R Quirk, against MENTALIST (L O’Reilly), placed 2nd by the judge, on the grounds that it “galloped in excess of 50 metres in the final 200 metres”.
The Respondent Mr O’Reilly had signed the Information indicating he did not contest the protest and he did not wish to be present at the hearing.
Section B of the Breaking Horses Regulations provides: that any horse which breaks in the last 200 metres of a race and continues in a break for a distance of 50 metres or greater shall be in breach of Rule 870(3).

Mr Quirk showed the race video replay of the final 200 metres of the race.
Mr Quirk identified MENTALIST contesting the lead passing the 150-metre mark. He pointed to the horse shortly after, gallop, free of interference, and continue on in a gallop past the winning post, finishing in second place. Mr Quirk said MENTALIST has galloped for at least 100 metres and therefore in breach of the galloping horse Regulations.
He said the Stewards were seeking disqualification of MENALIST from the race.

The Committee carefully considered all the evidence and video footage. The Committee was satisfied MENTALIST had galloped, free of interference, just prior to the 100m mark and continued in a gallop past the winning post, clearly further than 50 metres allowed in the Galloping Horse Regulations.
