Decision:

As Mr Shinde had admitted this breach of the Rules it was found to be proved.

Penalty:

Accordingly, Mr Shinde’s Class A licence was suspended from the conclusion of racing today 14 November up to and including 28 November 2019. Of note the meetings at Riccarton on 16 November and Waverley 17 November were not included in penalty as riders were already declared for both meetings.

Facts:

Chief Stipendiary Steward, Mr J Oatham, filed an Information against Class A Licensed Jockey, Mr S Shinde, the rider of BLAIR FLIGHT, in that he allowed his mount to shift inwards when not clear of DANNY GREEN (J Laking), REDLIGHT (M Cameron), and LEIGHTON WARRIOR (S Wynne) who were all crowded and checked near the 1300m.

Rule 638(1)(d) reads as follows;

“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:

(d) careless”

Mr Shinde had indicated on the Information that this breach of the Rules was admitted which he confirmed at the hearing. Mr Shinde also agreed that he understood the charge and the Rule it was brought under. As Mr Shinde had limited experience, race riding in New Zealand, he was assisted at the hearing by Mr D Walsh, NZTR Apprentice Jockey Mentor.

Mr Oatham gave evidence and used video coverage with the assistance of Stipendiary Steward, Mr A Coles, to show that approaching the 1300m, BLAIR FLIGHT, ridden by Mr Shinde, was racing wide on the track and looking to shift across and improve forward. Racing inside Mr Shinde was DANNY GREEN, ridden by Mr Laking, REDLIGHT, ridden by Mr Cameron and LEIGHTON WARRIOR, ridden by Miss Wynne. Mr Coles pointed out Mr Shinde shifting across the field and when not clear of DANNY GREEN, dictating that horse inwards, making contact and crowding REDLIGHT inwards and into the rightful racing line of LEIGHTON WARRIOR, who was also crowded and had to check. Mr Coles used side on views which showed Mr Shinde was only a bare length ahead of Mr Laking when shifting into the racing line of DANNY GREEN.

Mr Walsh, on Mr Shinde’s behalf, stated that Mr Shinde had misjudged the situation and shifted across when not clear. Mr Walsh said that Mr Shinde did have a look but was too late as the interference had already occurred.

Submissions for Penalty:

Mr Oatham stated that Mr Shinde had ridden extensively in India previously and had been in New Zealand for the prior 15 months. He said that Mr Shinde has only just started race day riding after shifting to the Southern District and to date had ridden on only 11 occasions. Mr Oatham stated that Mr Shinde had a clear record to date and the Stewards had assessed the carelessness as being towards mid-range, perhaps just a touch under. He submitted that a suspension along the mid-range lines would be appropriate in this case.

Mr Shinde elected to make no submissions on penalty.

Reasons for Penalty:

The JCA Penalty Guide provides a starting point for a mid-range breach of this rule of a 8-national day suspension. We assessed the breach at mid-level and therefore adopted the 8-national day starting point. There were no aggravating factors to consider, therefore no increase in penalty was warranted. Mitigating factors were Mr Shinde’s admission of the breach and his clear record. For these factors we able to afford Mr Shinde a combined discount, which we set at 1 day. The Committee therefore determined that a 7-national day suspension was an appropriate penalty in this case.
