As the breach was admitted we find the charge proven.

Penalty:

Balancing the above matters but with emphasis on the need for consistency, taking into account that breaches of this rule are very infrequent, Ms Spratt’s riders licence is suspended for 4 weeks commencing at the end of racing on the 13th November and concluding at the end of racing on the 10th December 2010. There is an order that Ms Spratt’s riding fee be forfeited in accordance with the provisions of rule 803(2)(b)(iii)

The facts of this matter are as set out in the decision in the associated Request for a Ruling Hearing. In brief Ms Spratt was the rider of ASKMEAGAIN which was placed 2nd by the Judge. After unsaddling the horse, she became involved in a heated argument with the Trainer, Mr R Yuill. Ms Spratt became upset and flustered and went straight to the jockey’s room without weighing in. The failure to weigh in resulted in the mandatory disqualification of ASKMEAGAIN.

Mr Coles said no jockey had been charged under this rule since it was amended about 2 years ago – the change requiring all jockeys to weigh in after a race. He referred to 3 cases under the old rule. Each case involved the rider of a horse which finished in the Judges placings. The penalty in one case was a 1 month suspension and in the other 2 cases there was a 4 week suspension. In 2 of the cases there was an order that the riding fee be forfeited. He submitted that a 4 week suspension should be imposed. 

 
Ms Spratt asked that the mitigating circumstances be taken into account and also that it was now approaching the busy part of the season. She asked for consideration of a suspension and a fine. 
 
Mr Coles said that he thought a period of suspension was the only appropriate penalty.

In fixing penalty the committee takes into account the admission of the breach, the submissions of Mr. Coles and Ms Spratt and the previous penalties imposed for a breach of the old rule.
