Placings were allowed to stand and payouts on the provisional placings as called by the judge were authorised.

Facts:

At the conclusion of Race 1 the siren sounded indicating a protest brought under rule 876 (1).
Provisional placings as called by the judge were 5 – 3 – 1 – 4.
Mr. D. Bradley, the rider of Princess Lincoln provisionally placed 4th by the judge, protested against Bandit Country (C. Carmine) provisionally placed 3rd by the judge. The margin was 1 ½ lengths.

Submissions for Decision:

Mr. Bradley, using the available films, informed the committee that on rounding the bend a clear gap was presented to his mount down on the inside and he was perfectly entitled to take that gap. He believed he was making progress and then the gap closed and he had to take hold. He pointed out the inward movement of Bandit Country, which although he agreed was gradual, did inconvenience his mount. Contact did occur he believed at one point. Under questioning he did agree that his mount did take a while to take the gap that was presented.

Mr. Carmine told the committee that yes his mount did move inwards. He felt that on straightening up after rounding the bend his mount took a while to become balanced and that contributed to that inward movement. It was Bandit Country’s second start as a 2 year old and he still has a lot to learn. He felt that there was plenty of room down on the inside even though his mount was drifting inwards Princess Lincoln did get into the gap and failed to run on.
Miss Bambry representing Mr Finnegan told the committee that she believed that Princess Lincoln did run up alongside Bandit Country and appeared hesitant to take the gap that was presented. She also asked the committee to take into account that 2 year olds do on occasion’s race erratically.
Stipendiary Steward Mr. Goodwin, under the rules, was asked to comment. He confirmed that in his opinion the available films showed that there was inward movement albeit gradual from Bandit Country. He believed that there was no outward movement from Mr. Bradley’s mount. There was a gap presented down on the inside and he wondered that even although Princess Lincoln did run up alongside whether the horse hesitated when the gap became available. He believed that Mr. Bradley did take hold and did confirm that the margin between 3rd and 4th was 1 ½ lengths.

Reasons for Decision:

We have viewed again the available films of the incident. There is no question that Bandit Country did gradually move inwards after rounding the bend. Although the movement was not great we believe that Bandit Country, having only its second start as a 2 year old, took a while to become balanced.

There was, we believe, a gap presented down on the inside and Princess Lincoln was perfectly entitled to angle in and take that gap. The available films especially the side on showed clearly that Mr. Bradley’s mount did get into the presented gap, we are of the opinion that prior to the slight contact being made that Princess Lincoln hesitated and did not continue to run on, leaving Mr. Bradley having no choice by having to take hold.
