As Mr Waddell admitted the breach the Committee found the charge proved.

Penalty:

Accordingly, Mr Waddell had his license to ride in races suspended for a period to commence after racing on 25 January and conclude after racing on 7 February 2020.

January 27 race meeting at Te Teko was not included in the penalty because the declaration of riders had closed.

Facts:

Following the running of race 2, Henley Park Mr Tiz Trophy, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Oatham, alleged that Mr Waddell permitted his mount RUN TO PERFECTION to shift inwards when not sufficiently clear of WOODCOTE LASS that was checked passing the 1100 metres.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Waddell said he understood the Rule and confirmed that he admitted the breach.

Mr Coles demonstrated the incident using the available video footage. He identified that near the 1100 metres Mr Waddell angled his mount inwards when only ¾ to 1 length clear of WOODCOTE LASS. As a result that runner was crowded and checked.

Mr Waddell said that he agreed with Mr Coles’ interpretation of the incident. He accepted that he made a mistake due to a tactical error after following BAVELLA inwards.

Submissions for Penalty:

Mr Oatham produced Mr Waddell’s record which showed 4 previous breaches under this Rule in the last 12 months, the most recent being on 3 October 2019. He said Mr Waddell made a minor error of judgement and the level of carelessness was at the low end. He said that Mr Waddell has had 181 rides since his last suspension. He noted that Mr Waddell was a busy rider and his record could be treated as a neutral factor.

Mr Waddell said that he had no upcoming engagements and any proposed suspension could start immediately. He submitted that he had a very good ratio of rides to suspensions. He asked the Committee to consider a combined fine and suspension if his suspension was going to include the Premier race meeting at Te Rapa on 8 February.

Reasons for Penalty:

The Committee considered all the evidence and submissions presented.

It was evident on the video films that Mr Waddell permitted his mount to shift in 1 horse width when only ¾ of a length clear of WOODCOTE LASS. The consequential effects were that runner was crowded and checked. The Committee deemed the level of carelessness to be low range.

The JCA Penalty Guide starting point for low range carelessness is 6 days which was adopted.

Mr Waddell’s record was deemed to be neutral factor given that 3 of his 4 previous breaches occurred more than 10 months ago.

The aggravating factors was the breach occurred in a Group 3 race worth $70,000 for which we applied a 1 day uplift in penalty.

The mitigating factor was Mr Waddell’s admission of the breach for which he was afforded a 1 day reduction in penalty.

The Committee advised Mr Waddell the expectation is that Judicial Committees no longer substitute a fine for the last day of a suspension where that day will be a Premier or Iconic day unless there are exceptional circumstances.

After taking into account all the above factors the Committee considered that an appropriate suspension was 6 national riding days.
