Mr Murray admitted the charge and it is found proved.

Penalty:

Mr Murray’s Apprentice Jockey’s Licence is suspended from the conclusion of racing today (13th August 2015) up to and including Timaru on the 21st August 2015. One South Island day.

Facts:

Following the running of race # 5 the OAMARU SCAFFOLDING MAIDEN an information was lodged by Mr J McLaughlin alleging “...Mr Murray weighed in 0.9 to 1kg over his weigh out weight...”

Rule 648 (5) reads:

If the Rider of a horse weighs in at a weight of 0.5kg or more in excess of that which he weighed out:

(a) That Rider, ...commits a breach of these Rules.

Mr Murray was present at the hearing and admitted the charge.

Mr McLaughlin stated that Mr Murray weighed out at 55kg for his ride on Coolin Roo. When he weighed in after the race the scales showed a weight fluctuating between 55.9kg and 56kg. The Clerk of the Scales reported the discrepancy to the Stewards.

Mr Murray stated he had consumed half a can of V after weighing out. However, he also admitted he had added a piece of extra gear.

Submissions for Penalty:

Mr McLaughlin stated the JCA Penalty guide recommended a fine starting at $500. He said Mr Murray was a very busy and sought after apprentice jockey and averaged between four to six rides per meeting.

Mr Harnett submitted that Mr Murray only received half his riding fee and that should be taken into account. He averaged four to five rides per meeting. He had admitted the charge and co operated with the Stewards. He asked a combined suspension and fine be considered by the committee. 

Reasons for Penalty:

Mr Murray weighed in .9 to 1kg over weight. An aggravating factor is his admission to adding gear after weighing out. In mitigation Mr Murray admitted the charge, was fully cooperative with the Stewards and the horse was unplaced. He asked a fine and suspension be considered.

Mr McLaughlin suggested a fine of $500 or a suspension.

The JCA Penalty guide recommends a fine of $500 and we take that as a starting point. We have increased the fine to $600 for the addition of gear after weighing out. Mr Murray is given credit for his early admission, his remorse and that he is an apprentice jockey. We also take into account his mount was unplaced and there was no effect to stake money or betting.

In setting a penalty we are mindful that a substantial fine may be an excessive penalty for an apprentice jockey.

In this instance we impose a suspension of one day as opposed to a fine.
