Facts:
Following the running of Race 2, 94.3FM The Sound of Kapiti Maiden, an Information was lodged with the Judicial Committee alleging a breach of Rule 638(1) (d) in that Miss K Chiong permitted her mount FLOSCEES GOLD to shift in shortly after the start when not clear of BROKEN BELT which was taken inwards resulting in SPANISH GOLD being checked.
Rule 638(1) (d) reads:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Miss Chiong and Mrs Zimmerman acknowledged that they understood the rule and the charge that had been preferred by the Stipendiary Steward.
All films were shown and Mr Goodwin identified the horses and riders and said that shortly after the start Miss Chiong allowed her mount to shift in onto BROKEN BELT who in turn was forced down onto SPANISH GOLD who was checked and lost about one and a half to two lengths. He added that although the interference occurred on the bend, Miss Chiong should have given the runners to her inside sufficient racing room.
Miss Chiong admitted shifting in, but said she thought that she had been clear of the horse racing on her inside.
Submissions for Penalty:
Mr Goodwin said that Miss Chiong had not been charged with careless riding during the past twelve months hence her record was very good. He said that the Stipendiary Stewards placed the carelessness in the mid-range and said that a suspension would be the appropriate penalty.
Miss Chiong said that she would like any suspension imposed to commence after racing on 11 September 2014.
Mrs Zimmerman invited the committee to have regard to the section of the track where the interference occurred (bend) and her good record. She added that Miss Chiong needs to be more careful and said that in her opinion the interference was not particularly bad.
Reasons for Penalty:
The JCA starting point for careless riding is a suspension of 5 riding days. In fixing penalty the committee took into account Miss Chiong’s very good record, her admission of the breach and that the carelessness was deemed by the committee to be in the mid-range category. Having due regard to all those matters the committee determined that a suspension of 4 riding days was befitting for such a breach of the Rule.
