As Ms Collett admitted the breach the Committee found the charge proved.

Penalty:

Accordingly, Ms Collett was fined $200.

Facts:

Following the running of race 8, Hallmark Stud Handicap (Listed Race), an Information was filed pursuant to Rule 649(1)(a). The Informant, Mr Oatham, alleged that when saddling MUMMS JEWEL (A Collett) an iron and leather was found to be missing.

Rule 649(1) (a) provides: A Rider must not:

(a) do or permit any wrongful act or omission with respect to weight or weighing

Ms Collett acknowledged that she understood the Rule and confirmed she admitted the breach.

Mr Oatham told the Committee that Mr Gibbs, the Co-Trainer of MUMMS JEWEL, had alerted the Stewards that when he was saddling his horse Ms Collett’s saddle was minus an iron and leather. As a consequence Ms Collett had to reweigh and the start was delayed by 2 to 3 minutes.

Ms Collett said that she is struggling to explain the situation. She said that she weighed out with the correct weight, the saddle was in good condition and the missing iron and leather has not been found.

Submissions for Penalty:

Mr Oatham said that this was an unusual situation although a similar occurrence happened on 2/11/2019 when Mr C Johnson was fined $100. He said given this was a black type race a $200 fine would be appropriate.

Ms Collett accepted that a monetary fine would be imposed.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

The circumstances are rare and there was no suggestion that Ms Collett was trying to gain any advantage when weighing out.

The JCA Penalty Guide states that a breach of this Rule is fact dependant.

The aggravating factor was the breach occurred in a black type race.

The mitigating factors were Ms Collett’s admission of the breach and her clear record under this Rule.

After taking into account all the above factors the Committee considered that an appropriate penalty was a $200 fine.
