Mr Cook admitted the charge and it is found proved.

Facts:

Following the running of Race 1 the Bishopdale & Bush Inn TABS Amateur Drivers Mobile Pace Stewards charged Mr P Cook with a breach of careless driving. The Information alleged that Mr Cook …drove carelessly entering the final straight by allowing his horse to hit the sulky wheel of BEAUDIENE GAMBLER which in turn caused his horse to break.”

Rule 869 (3) (b) reads:

No horseman in any race shall drive (b) carelessly.

Mr Cook admitted the charge and appeared at the hearing.

Mr Munro, with the aid of the video replays, pointed out the relevant position of MYBOYLOLLIEPOP as the field approached the 400m mark. He said MYBOYLOLLIEPOP was racing near the rear of the field. As the forward runners fanned out on the home turn Mr Cook had improved MYBOYLOLLIEPOP to a trailing position behind BEAUDIENE GAMBLER. He said as the field entered the home straight MYBOYLOLLIEPOP made heavy contact with the sulky wheel of BEAUDINE GAMBLER, causing MYBOYLOLLIEPOP to break and lose any chance.

Mr Cook stated his horse was travelling well on the turn. He said he thought he had a gap and did not realise there was a horse in front of him.

Submissions for Penalty:

Mr Munro stated Mr Cook had a very good clean record. He’d had 14 drives this season and 58 drives lifetime. He said the incident resulted in the chances of MYBOYLOLLIEPOP being extinguished.  He sought a fine of between $350 and $400 or a suspension of 3-4 months.

Mr Cook said he would prefer a fine. He was aiming for the Amateur Drivers Championship later in the season and any suspension would impact on his chances of contesting that series. He said he was disappointed in his drive especially as he was a part-owner of the horse as well.

Reasons for Penalty:

Mr Cook made an error at a critical stage when looking for racing room at the top of the home straight causing BEAUDIENE GAMBLER to lose any chance. The Stewards sought a fine of up to $400 or a suspension of 3-4 months. Mr Cook preferred a fine as opposed to a suspension. Mr Cook has an excellent record and admitted the breach at the outset. It is the first time he has been charged with a driving offence and we give him credit for those factors. A fine is appropriate in this instance.
