Facts:

Following the running of r 1 the Zilco/Invercargill Workouts Trot Stewards charged Mr R Stevens with excessive use of the whip, r 869 (2) in that “…he used his whip outside Clause (b) of the Whip Regulations when driving DIPENDRA.”

Rule 869 (2) reads:

No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board:

Clause (b) of the Whip Regulations reads:

No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400m. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.

Mr Stevens admitted the charge and appeared at the hearing.

Mr Wallis stated that Mr Stevens (DIPENDRA) was leading the field when turning in to the final straight. He said Mr Stevens struck the shaft three times with the whip and over the final 200m struck his horse 9 times with the whip. In total 12 strikes which was a breach of the rule and the regulations.

Mr Stevens said he had only recently returned to race driving and was not aware of the change. He had not realised striking the shaft with the whip was a breach of the rule. He believed he was trying to urge his horse on.

Submissions for Penalty:

Mr Wallis said Mr Stevens had admitted the breach, had a good record and his breach was at the lower end of the scale. He sought a fine of $200 as per the penalty guidelines.

Mr Stevens accepted a fine.
