Facts:

Following the running of Race # 3 the MONARCHY MOBILE TROT Stipendiary Steward Mr N Ydgren lodged a protest against the first placed runner DREAMLOVER (KM Barron). The Information alleged DREAMLOVER was an incorrect gait in excess of 50m inside the final 200m. The protest was lodged alleging a breach of Rule 870 (3) and the Breaking Horses Regulations.

Rule 870 (3) states: Any horse which breaks from its gait shall promptly regain its proper gait.

Breaking Horses Reg. (b) states: Any horse which breaks from its gait within the final 200m of any race and continues on in a break for a distance of 50m or greater, shall be deemed to be in breach of Rule 870 (3) in that it has failed to promptly regain its proper gait.

Submissions for Decision:

Mr Ydgren, with the use of the video, stated DREAMLOVER was racing clear of the field prior to the final 50m peg in the home straight. He stated DREAMLOVER switched to a pacing gait for one stride about the 50m mark before breaking. DREAMLOVER recovered its proper gait approx. one stride from the finish.

Mr Ydgren stated DREAMLOVER lost ground in the break but was in its correct gait at the finish. The issue was whether DREAMLOVER was in an incorrect gait for 50m or more.

Mr Barron stated the horse had switched to a pace before breaking. The horse had regained its correct gait a stride from the finish. He believed DREAMLOVER was not in breach of the regulation.

Reasons for Decision:

To uphold the protest under Rule 870 (3) the committee has to first be satisfied that DREAMLOVER has breached the Breaking Horses Regulation (b). After viewing the videos and hearing the evidence of both Mr Ydgren and Mr Barron, the committee was satisfied the evidence was inconclusive and that a breach of the Regulation had not been proved.
