As Mr Dell admitted the breach we find the charge proved.
Penalty:
Accordingly we impose a suspension on Mr Dell which will commence after racing on 7th December 2011 and conclude after racing on 11th December 2011 (4 days).
Charge:
Following race 3 an information was filed pursuant to Rule 638(1) (d). The informant Mr Williamson alleged that Mr Dell permitted his mount RONALDINO to shift outwards near the 200 metres when not sufficiently clear of APACEE TUTE (M Vance) which was crowded and checked making contact with DUKEOFSANDHURST (M Sweeney).
Facts:
Mr Coles demonstrated the video films which showed approaching the 200 metres Mr Dell riding RONALDINO was racing in a tight position with no direct line of running. Shortly after this Mr Dell angles his mount out for a run and into the line of Ms Vance when only 1 length clear.
Mr Dell in admitting the breach said his horse had shied at a runner on his inside in the first instance. However he acknowledged when he was committed to a run on his outside he was not the required distance clear.
Ms Evans said Mr Dell was a young rider who was simply trying too hard when the gap was presented.
Submissions for Penalty:
Mr Williamson produced Mr Dell’s record which showed no previous suspensions in the last 12 months. He said Mr Dell had recently gained a class B license having previously had a class D jumps license which showed no breaches under this rule. He submitted the degree of interference was low range and with Mr Dell’s early admission and his good record a suspension at the low end would be appropriate.
Mr Dell informed the committee he had commitments at Ellerslie on the 7th December 2011 and asked for a deferment to his suspension. Mr Dell confirmed to the committee he rides only in the North Island.

The committee carefully considered all the evidence and submissions as presented. The mitigating factors are, Mr Dell’s admission of the breach and his very good riding record. The aggravating factors are, his level of carelessness which we assess as low end, and the interference received by Ms Vance. We grant Mr Dell a deferment to his suspension as per rule 1106. The Committee reminded Mr Dell the need to exercise more care when shifting ground.
