As Mr Wiles admitted the breach the Committee find the charge proved.

Penalty:

Mr Wiles was fined the sum of $300.

Facts:

Following the running of race 1 Ultimate Motor Group 1200, an Information was filed pursuant to Rule 614 (2). The Informant, Mr Jones, alleged that Mr Wiles omitted the lead bag from LONE WARRIOR when saddling.

Mr Wiles acknowledged that he understood the Rule and confirmed his admission of the breach.

Rule 614(2) states: A person must not be neglectful or careless in saddling a horse.

Mr Jones advised the Committee that Stipendiary Steward Mr Robinson had identified the omitted lead bag for LONE WARRIOR when carrying out routine checks at the plate inspection area. When Mr Jones carried out his investigation it was established that Mr Wiles had 2 horses in race 1 and on his way to the stables he dropped the saddles which dislodged the lead bag. He said it was unfortunate that Mr Wiles had a broken hand but it was his obligation not to be neglectful in saddling a horse. Mr Jones advised that when the error was detected both horses were re weighed and re saddled without causing any delay.

Mr Wiles acknowledged that he dropped both saddles on the way to saddling his 2 horses. He said when he picked up the saddles he got the lead bag mixed up.

Submissions for Penalty:

Mr Jones produced Mr Wiles' record which showed no previous breach under this Rule. He said the JCA Penalty Guide recommended a starting point of $500 and referred to recent penalties which incurred $300 fines. Mr Jones submitted a fine in the vicinity of $300 would be appropriate.

Mr Wiles submitted that although he had a broken hand it was his mistake and recognised a monetary penalty would be imposed.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. The Committee have adopted a $500 fine as the starting point as per the JCA Penalty Guidelines. The mitigating factors were Mr Wiles' admission of the breach and his clear record in relation to this Rule for which he has been given a discount.

The Committee was satisfied that the incident was a genuine mistake on Mr Wiles' part.

After taking into account all the above factors the Committee considers an appropriate penalty was a $300 fine.
