As Mr Yanagida admitted the breach the Committee found the charge proved.
Penalty:
Accordingly, Mr Yanagida had his license to ride in races suspended for a period to commence after racing on 29 September and conclude after racing on 12 October 2018.
The 30 September race meeting at Te Aroha was not included in the penalty because it is scheduled for Jump / Highweight and Amateur riders only.
Facts:
Following the running of race 8, Waikato Stud – Six Time Breeder of the Year 1400, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Oatham, alleged that Mr Yanagida allowed his mount AMEN CORNER to shift in from near the 350 metres causing interference to HARBOURSIDE and EL COOLIO.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Yanagida said that he understood the Rule and confirmed that he admitted the breach. Mr N Harris assisted Mr Yanagida at the hearing.
Mr Oatham demonstrated the incident using the available video footage. He identified that at the 250 metres Mr Coleman, the rider of HARBOURSIDE, had established a run to the inside of AMEN CORNER, ridden by Mr Yanagida. He said that Mr Yanagida rode his mount forward and it shifted in 2 horse widths into the running line of HARBOURSIDE which was checked. He said Mr Yanagida did attempt to relieve the inward pressure but the interference had already occurred.
Mr Oatham pointed out on the video films that near the 75 metres AMEN CORNER again shifted in with HARBOURSIDE being forced inwards causing a bad check to EL COOLIO. He said Mr Yanagida made some effort to correct his mount but it was too little too late. He said the interference was sustained over a long distance which resulted in AMEN CORNER being relegated from 2nd place.
Mr Yanagida said that he accepted Mr Oatham’s interpretation of the interference and had nothing further to add.
Mr Harris acknowledged that Mr Yanagida overstepped the mark between competitive riding and riding in a careless manner.
Submissions for Penalty:
Mr Oatham produced Mr Yanagida’s record which showed no breaches under this Rule. He said that Mr Yanagida has been riding for 9 months and has had 109 rides to date. He said Mr Yanagida was making good progress and was a promising apprentice rider. He described the level of carelessness as beyond mid-range and as a result of Mr Yanagida’s carelessness AMEN CORNER was relegated from 2nd place. In conclusion he said Mr Yanagida has an excellent record, admitted the breach and was an inexperienced rider.
Mr Yanagida advised that he had engagements on 29 September and any proposed suspension could start after that date.
Mr Harris asked the Committee to take into account Mr Yanagida’s excellent record.
Reasons for Penalty:
The Committee carefully considered all the evidence, submissions presented and reviewed the video films.
The Committee found that Mr Yanagida failed to make sufficient effort to prevent his mount from shifting in approximately 2 horse widths when not sufficiently clear of HARBOURSIDE which was checked near the 250 metres.
The Committee also found that passing the 100 metres AMEN CORNER again shifted in under pressure when not sufficiently clear. At that point Mr Yanagida was riding his mount forward with the whip, as a consequence HARBOURSIDE was forced inwards causing a severe check to EL COOLIO. When being checked EL COOLIO made contact with the hind quarters of ACRE and lost several lengths.
The Committee deemed the totality level of carelessness displayed by Mr Yanagida was in the mid to high range.
The JCA Penalty Guide starting point for mid to high range carelessness is 9 days which was adopted.
The aggravating factor was as a consequence of Mr Yangida’s carelessness AMEN CORNER was relegated from 2nd place. An uplift in penalty of 1 day was applied.
The mitigating factors were Mr Yanagida’s admission of the breach and his unblemished record. For these combined factors Mr Yanagida was afforded a 2 day reduction in penalty.
After taking into account all the above factors the Committee considered that an appropriate suspension was 8 national riding days.
