The events described above materially prejudiced the chances of "Rosso Corsa" and the Committee has decided to exercise its discretion and declare "Rosso Corsa" a non-starter.

Authorisation is given to the payment of amended dividends.

Facts:

Following the running of Race 8, the WWW.Warriors.Kiwi 2100, Information A8524 was filed by Senior Stipendiary Steward, Mr Williamson seeking a request for a ruling under Rule 632. The Information requested "whether "Rosso Corsa" was denied a fair start".
  
Rule 632 states "If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter".

Submissions for Decision:

Stipendiary Steward, Mr Coles used the head-on film of the start of the race to highlight "Rosso Corsa" who was drawn in barrier 15 in the 15 horse field – the outside barrier. He said the film showed that as the gates opened an attendant had hold of the left ear of "Rosso Corsa". He then said as the horse jumped out of the gate he thought it had hit its head on the side of the gate due to attendant still having a hold of its ear.

To a question from the Committee Mr Waddell, the rider of "Rosso Corsa", said he was 95% certain that his horse’s head had hit the side of the gate as it jumped. He further said, however, that as the plan was to ride the horse back he was not too disadvantaged although ended up being a couple of lengths further behind the body of the field than he intended to be.

The trainer of "Rosso Corsa" Mr Bell said the film showed the horse was clearly hampered as the gates opened.

The Starter, Mr Harrison, had nothing new to add to what had already been said and said in his view "Rosso Corsa" had been denied a fair start.

Mr Williamson concluded by saying it was clear that an attendant did have hold of the horse’s ear as the gates opened and this contributed to the horse contacting the gate as it jumped. He submitted that to be fair to the connections of the horse and the betting public the horse should be declared a non-starter.

Reasons for Decision:

The Committee has carefully considered the films of the start and submissions of all parties. The film clearly shows an attendant holding the ear of the horse as the gates opened and that this also caused the horse to hit the left hand side of the opened gate as it jumped. We note that Mr Waddell was 95% certain that the horse had hit the side of the gate. We also note from the film that "Rosso Corsa" lost approximately 2 lengths at the start. Finally we note that "Rosso Corsa" finished 12th in the race.
