We find the breach proved. 

Penalty:

Mr Golding is fined the sum of $200. 

Charge:

Mr Allison alleged that Mr Golding used his whip excessively on STILL LAUGHIN over the final stages.

Facts:

Mr Allison demonstrated on the videos that STILL LAUGHIN was in the parked position and that the respondent used his whip some 24 or 25 times from the home turn. 

Submissions for Decision:

Mr Allison said some strikes were back-handers and the horse was also pushed with the whip on occasion.

Mr Golding said that he had only been beaten by a nose for 2nd and that STILL LAUGHIN was gathering in the other horses in the last 100 metres. Mr Court, emphasised that some striker were back-handers, which did look as bad, and that the strikes were not forceful. In his experience, the horse was one that needed encouragement to give its best.

Reasons for Decision:

Mr Golding admitted the breach.

Submissions for Penalty:

Mr Allison submitted that a fine of $200 was appropriate.

Mr Court stated that the respondent was a junior driver of limited means. He asked that the fine be at the lower end of the range.  

Reasons for Penalty:

We believe Mr Allison’s count of 24 is 25 very generous to the respondent. If the back-handers are taken into consideration the number is around 30. This is simply far too many, despite taking into account the horse is a “grinder” and was just beaten for 2nd. In mitigation is Mr Golding’s ready admission of the breach, he is a junior driver, and that this is his first breach of the rule. He has had 8 drives this season and 101 in the last. From the starting point of $300 we give a $100 discount.
