Mr T Larsen was fined the sum of $150 and encouraged to take up the opportunity on furthering his education around this specific Rule, as offered to him by Mr Munro.

Facts:

Following the running of Race 3, Fear The Dragon At Macca Lodge Mobile Pace, Information A10668 was lodged by Stipendiary Steward, Mr V Munro alleging Junior Driver, Mr T Larsen (Bettors Highlight) used his whip in more than a wrist flicking motion in the home straight.

Mr Larsen admitted the breach of the Rule and confirmed at the hearing he understood the Rule.

Rule 869(2) and Whip Regulations provide:
(3.1) A driver may only apply the whip in a wrist only flicking motion whilst holding a rein in each hand with the tip of the whip pointed forward in an action which does not engage the shoulder.

Mr Munro showed the video replays of the race from the home straight, highlighting BETTORS HIGHTIGHT travelling three wide into the straight with Mr Larsen raising his whip on four occasions over 40 metres, in more than a wrist flicking motion.

Mr T Larsen said he was struggling with the Rule but accepted Mr Munro’s version of the events.

Mr K Larsen, in support, said that as a Senior Driver he also was having difficulty with this particular Rule.

Submissions for Penalty:

Mr Munro stated that Mr T Larsen was a Junior Driver, who had 107 lifetime drives, 40 last season and 65 this season. Mr Munro referred to the JCA Penalty Guide as a starting point for a low end of the breach of a fine of $200.

Mr Munro confirmed that Mr Larsen would receive some further education regarding this Rule.

Mr Munro highlighted that Mr Larsen had no previous charges under this Rule and he had admitted the breach at the first opportunity.

Mr Larsen Sr reinforced to the Committee that Mr T Larsen was a Junior Driver and was trying hard to interpret the Rule and had simply made an error of judgement.

Reasons for Penalty:

The Committee agreed with Mr Munro’s summation that the breach of the Rule was at the low end.

The JCA Penalty Guide sets a starting point of $200 for a breach at this level.

In this instance the committee has used its discretion to reduce penalty by $50 due to the early admittance of the breach and no previous charges and also that Mr T Larsen is a Junior Driver believing a fine of $150 is appropriate.
