Facts:

Following the running of the CAMBRIDGE HOME OF 2016 JEWELS JUNIOR DRIVERS HANDICAP TROT an Information instigating a Protest was lodged by Stipendiary Steward Mr JM Muirhead against the 3rd placing of VALMAGNE on the grounds that it broke near the 150 metres mark in the home straight and failed to regain its proper gait by the finishing post.

The Breaking Horses Regulations provide: that any horse that breaks from its gait in the last 200 metres of a race and continues in a break for a distance of 50 metres or greater shall be in breach of rule 870(5) in that it has failed to promptly regain its proper gait.

Mr Josh Kennett the co-Trainer and Driver of VALMAGNE endorsed the Information with the words "I do not contest the Protest"

Mr Muirhead demonstrated the incident by use of the race films and showed where VALMAGNE broke with at least 150 metres to run and continued in a break for the remainder of the race.

Mr Muirhead submitted that as VALMAGNE had breached the provisions of the Rule and the Regulations that it should be disqualified from the race.
