Mr McNab’s licence to ride in races will be suspended from the conclusion of racing on Thursday 2nd August 2012 until the conclusion of racing on Thursday 9th August 2012. This is a total of four (4) days. This incorporates the Whangarei (3rd), Whangarei (4th), Hawke’s Bay (6th) and Waverley (9th) meetings.
Charge:
Following Race 4, Apprentice Jockey M McNab was charged with careless riding under Rule 638(1)(d). The information stated ”Mr McNab allowed his mount to shift in causing interference to CONCENTRIC, NOTTOBAD and VANILLA soon after the start.”
Rule 638(1)(d) states:
“A Rider shall not ride a horse in a manner which the Judicial Committee considers to be: … (d) careless.”
Facts:
Mr McNab indicated to the committee that he understood Rule 638 (1)(d), and that he admitted the breach.
Using the head-on film, Mr Goodwin identified Mr McNab’s horse (INDIANA JONES), CONCENTRIC (T Russell) to his immediate inside, NOTTOOBAD (M Cameron), and VANILLA (D Bradley) racing nearest to the running rail. Mr Goodwin alleged that Mr McNab had attempted to improve his mount across from a wide draw, and that INDIANA JONES appeared to be racing attractively at this time as Mr McNab did not appear to be having any difficulties with his mount.
On the film, he pointed out Mr McNab looking across before commencing the movement in order to gain a run closer to the rail. In doing so, he had not been clear of CONCENTRIC, which was dictated inwards into the line of NOTTOOBAD, which along with VANILLA received sharp buffeting in the incident. Mr Goodwin submitted that it was fortunate for Mr McNab that none of the runners had received a significant check, but rather a serious degree of tightening. He advised the committee that he had spoken with the other riders concerned and as a result he did not believe they had lost their position due to the incident, but that nonetheless, interference did occur. The films also identified INDIANA JONES’ head pull outwards as a result of Mr McNab realising he had caused some interference, and did attempt to relieve the pressure, albeit a little too late.
Mr McNab confirmed this, stating that as soon as he had realised what was happening, he tried his best to try and correct his actions, but accepted that this was too late.
Mr Campin, in assisting Mr McNab, commented that during the preliminaries it was evident INDIANA JONES was a very head-strong horse having its first start. He observed Mr McNab have a difficult time during the preliminaries and Mr Campin believed that whilst his jockey attempted to straighten his runner when he realised the impact on those runners to his inside, the horse did not give an instant response and he believed this was due to INDIANA JONES’ raceday inexperience.
Submissions for Penalty:
In presenting Mr McNab’s record, Mr Goodwin identified that Apprentice McNab had one suspension within the last 12 months; on 3 April at Matamata for four days. The stewards believed the level of carelessness fell within the mid-range on this occasion and that a four to five day period of suspension would be appropriate.
Mr McNab indicated that he had riding engagements up until Thursday 2 August. He stated that he rides predominantly in the North and Central Districts and had ridden at Whangarei recently. He concurred with the submission of a suspension of four to five days.
Mr Campin did not wish to make any comments with regard to penalty.
Reasons for Penalty:
The committee had regard to all of the submissions put before it. We accepted that whilst positional placings at this early stage in the race may not have been at risk on this occasion, there was still a safety element and potential for harm which could have eventuated. An aggravating feature of Mr McNab’s carelessness was that his actions affected three other horses and their riders; Mr Russell became unbalanced, VANILLA’s hind quarters turned inwards, and both CONCENTRIC and VANILLA received tightening. Accordingly, we placed the level of carelessness within the mid-range and believed that a period of suspension was an appropriate penalty to impose on this occasion, and adopted a starting point of five days. In mitigation, the committee considered Mr McNab’s’ early admittance of the breach and his very good riding record. Whilst Mr McNab did make an error of judgement, he did try to correct this, but the committee accepted that the inexperience of INDIANA JONES meant the response that Mr McNab may have expected as a result of taking corrective action was not as forthcoming as he would have anticipated. On balance it was decided that a four day period of suspension would be appropriate. The committee also consented to a deferment of the suspension in order to allow Mr McNab to fulfil riding engagements on Thursday 2 August.
