The protest is dismissed and the Judge's placing’s shall stand.

The Committee authorised the payment of stakes and dividends in accordance with its decision. 

Facts:

Following the running of race 7, Auckland Eye Avondale Guineas, an Information was filed Instigating a Protest pursuant to Rule 642(1). The Informant, Mrs Tiley, alleged that RANGIPO or its rider placed 1st by the Judge interfered with the chances of her horse BRIGHTON placed 2nd by the Judge.

The interference was alleged to have occurred inside the final 200 metres.

The Judge's placing were as follows:

1st No. 2 RANGIPO
2nd No. 10 BRIGHTON
3rd dead heat No. 4 RAGHU and No. 5 GET THAT JIVE

The official margin between 1st and 2nd is a neck.

Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.

All connections present acknowledged they understood the Rule.

Submissions for Decision:

Mrs Tiley submitted that BRIGHTON was finishing the race strongly when RANGIPO moved out into her running line. She said her mount was hampered and believed it cost her ¾ of a length. She added that RANGIPO shifted out a full own strip.

Mr Pike submitted that BRIGHTON was under severe pressure and he stated Mrs Tiley never stopped riding her mount. He said RANGIPO won the race comfortably and believed the winning margin looked more than a neck. He said BRIGHTON had every chance to get past RANGIPO but was not good enough.

Mr Colgan said he agreed with Mr Pike’s submissions and stated that he was a bit weak on RANGIPO over the last 100 metres. He said he only did enough to win the race.

Mr Oatham submitted that the interference was low level and it occurred close to the finish line. He said the Stewards are not fully satisfied that BRIGHTON would have beaten RANGIPO if no interference had occurred.

Reasons for Decision:

The Committee carefully considered all evidence and submissions presented and reviewed the video footage several times. We established that RANGIPO shifted out inside the final 100 metres and in doing so dictated BRIGHTON wider on the track over the closing stages of the race. It is noticeable that BRIGHTON lost no momentum when the incident occurred and Mrs Tiley did not have to stop riding her mount. The Committee is of the opinion that the interference that occurred did not have a bearing on the outcome of the race.

After taking into account all the above factors the Committee is not satisfied that BRIGHTON would have beaten RANGIPO had such interference not occurred.

Accordingly there are insufficient grounds to justify a change of placing's.
