As the breach was admitted we find the charge proved.

Penalty:

Accordingly we impose a fine of $150 on Mr Vince.

Facts:

Following the running of Race 1,  the OASIS CLEARWATER SYSTEMS AMATEUR DRIVERS MOBILE PACE an Information was lodged by Stipendiary Steward Mr J Muirhead alleging that Advanced Amateur Driver T Vince had breached Rule 857 (7) (g) in that he failed to maintain his position behind the mobile gate with the horse DEBS PAL.

Mr Vince indicated on the Information that he admitted the breach. He elected not to be present at the hearing.

Rule 857 (7) (g) provides that " No horseman shall fail to come up into and/or maintain his position"

Mr Muirhead, using the available films of the start of this race, pointed out that Mr Vince had started from barrier position 7 towards the outer of the horses on the front line. He stated that Mr Vince had been up on the gate at the early part of the score up, then eased his horse back at least 1 1/2 lengths just prior to the start and had made no attempt to improve DEBS PAL into the correct position at the start.

He therefore was in breach of this Rule.

Submissions for Penalty:

Mr Muirhead submitted that the JCA Penalty Guide showed a starting point of a $250 fine.

He said Mr Vince had been very frank and admitted the breach when spoken to. He had a clear record under this Rule.

Reasons for Penalty:

The Committee accepted Mr Muirhead's submissions on an appropriate penalty.

As Mr Vince was not present we have no submissions from him to consider.

Looking at other fines for similar breaches of this Rule we consider a fine of $150 to be appropriate.
