Facts:

Following the running of Race 6, Nicowear Teamwear Apparel Handicap Trot, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Graduation Driver, Mr R B Keats, alleging that, as the driver of STORMY LOCH in the Race, he “used his whip in an unnecessary manner over the concluding stages of this event”.

Mr Keats was present at the hearing of the information and he indicated that he admitted the breach.

Rule 869 provides as follows:
(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.

Submissions for Decision:

Mrs Williams showed video replays of the final 300 metres of the race. She pointed out Mr Keats, driving STORMY LOCH, racing on the inside at the rear of the field as the field turned into the home straight. Mrs Williams alleged that, from that point, Mr Keats had used his whip approximately 8 times. She said that the first two were acceptable to the Stewards because Mr Keats was trying the horse. The remaining strikes were unnecessary, in the view of the Stewards, as the horse had not responded and the outside horses were passing STORMY LOCH. There was no possibility of the horse running in the first six placings. This was a case of the whip being used on a clearly beaten runner.

Mr Keats said that he had only used his wrist to keep the horse up to his work. He submitted that it would not look too bad to the viewing public and that it was not a bad case of its kind. Mr Keats said that he has just one horse racing, but the horse races quite regularly. He indicated that he would prefer a fine to a term of suspension.

Mr Keats has had 16 drives in the current season to date, Mrs Williams said.
 

Submissions for Penalty:

Mrs Williams referred to the penalty guide that came into effect on 1 June which recommended a starting point for a breach of the Rule a fine of $300. She reminded the Committee that Mr Keats had admitted the breach and said he had a clear record.

 

Reasons for Penalty:

In determining penalty, the Committee took into account the starting point of a $300 fine given in the Penalty Guide and gave Mr Keats credit for his admission of the breach and his good record. The Committee viewed the breach as being in the low-mid range.
