Accordingly the protest is dismissed and the Judge's placings shall stand. In conclusion we order the payment of stakes and dividends.

Facts:

Following the running of Race 6, Simply Squeezed 1400, an information was filed Instigating a Protest pursuant to Rule 642(1). The Informant, Mr Grylls, alleged that ARNOLD placed 1st by the Judge interfered with LET'S BE A STAR placed 2nd by the Judge.

The interference was alleged to have occurred in the final straight.

The Judge's placing were as follows:

1st No.    2  ARNOLD
2nd No. 11  LET'S BE A STAR
3rd No.   5  BARSTORM
4th No.   1  NATSINGA

The official margin between 1st and 2nd was a nose.

Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.

Submissions for Decision:

Mr Grylls submitted that at the 100 metres Arnold came up and dictated his rightful running line which forced him to stop riding momentarily. He said this caused him to lose balance. He conceded that there was no contact between the 2 horses. He added that the short margin at the post should be considered by the Committee.

In response to a question from the Committee, Mr Grylls told us he stopped riding his mount for 1 or 2 strides.

Mr Peterson submitted there was no contact between the 2 horses however he believed Arnold rolled out 4 to 5 metres which caused Mr Grylls to straighten his mount. He said it was noteworthy that his horse was beaten by a nose and the existing heavy track made it hard for horses to make up ground.

Mr Weatherley when asked had nothing to submit.

Mr Harris submitted this was a frivolous protest as he had come from behind Let's Be A Star and said Mr Grylls did not stop riding his mount. He added that Let's Be A `Star was running away from Arnold on its own accord and pointed this fact out on the video films.

Mr Richardson submitted that Arnold was always going to beat Let’s Be A Star. He said this was the most pathetic protest he had been involved in and was embarrassed to be present.

Mr Oatham when asked for the Stewards' interpretation of the alleged interference submitted that Let's Be A Star was laying out away from Arnold in the final 100 metres. He said there was no contact between the 2 horses and Arnold had come from behind Let's Be A Star to win the race. Therefore the Stewards did not support the protest.

Mr Grylls when given the opportunity to sum up had nothing further to add.

Reasons for Decision:

The Committee carefully considered all evidence and submissions presented and reviewed the video films several times. We established at the 250 metre mark Arnold was approximately half a length behind Let's Be A Star which was been hard ridden at the time. We noted that Let's Be A Star started to drift out on its own accord at approximately the 200 metres. The Committee is satisfied that there was no contact between the 2 horses in the final straight and it was significant that Arnold had come from behind Let's Be A Star to win the race. The films showed that Mr Grylls did not have to stop riding his mount in the final straight. We are clearly of the view that Arnold won the race fairly and squarely with the alleged interference not being supported by the video films.

For these reasons we are not satisfied that Let's Be A Star would have beaten Arnold.
