In exercising our discretion to relegate TWO WISHES we are satisfied that that horse drifted out into the running line of GAME AS NED KELLY at approximately the 60 metre mark. The consequence was that GAME AS NED KELLY and HU KEAS both suffered interference and galloped. This interference affected both the chances and progress of GAME AS NED KELLY and HU KEAS.

Facts:

Mr Renault, stipendiary steward, alleged that TWO WISHES (P Holmes) shifted outwards with approximately 50 metres to run, checking GAME AS NED KELLY (M Evans) onto HU KEAS (J Curtin).

Submissions for Decision:

Mr Renault called Mr Curtin who stated that when progressing down the outside he had received interference from his inside. He acknowledged his horse had been going rough earlier. He said after he pulled the 1/2 blinds, Mr Evans was calling out loudly to Mr Holmes and HU KEAS went into a mad gallop as a consequence.

Mr Evans, who was racing inside Mr Curtin, stated things had become tight. He said the movement was from his inside and that Mr Holmes had moved out into his racing line and he had had to check. He did not know if there had been contact.

Mr Renault demonstrated the incident on the back-on and side-on videos. He said this showed that, with approximately 50 metres to run, TWO WISHES (P Holmes) had shifted outwards into the line of GAME AS NED KELLY, which, in turn, had moved into the line of HU KEAS. He said whether or not there was contact between TWO WISHES and GAME AS NED KELLY was irrelevant, as Mr Evans had had to check his horse as a consequence of the movement from TWO WISHES.

Mr Holmes used the head-on video to demonstrate that Mr Evans had had the opportunity to race inside of him but had chosen to race on his outside. He said TWO WISHES had run out about a cart width all the way down the straight. He did not believe there was contact with GAME AS NED KELLY.

Reasons for Decision:

We are satisfied that TWO WISHES has moved out gradually in the run down the straight but, more particularly, at about the 50 to 75 metre mark it had come into the running line of GAME AS NED KELLY forcing that horse wider on the track. This appeared to be at the time Mr Holmes gave a back-handed flick to the left-side rump of TWO WISHES. The consequence was that GAME AS NED KELLY had to check. Both GAME AS NED KELLY and HU KEAS broke and galloped across the line.

Mr Holmes is correct when he says a run was available inside of TWO WISHES for GAME AS NED KELLY. However, as we pointed out to Mr Holmes, it is within Mr Evans’ discretion to decide which running line he will take. Provided, of course, he remains with the rules. On this occasion, we find that he did.
