The Protest is upheld and LEMOND is disqualified from the Race.

The amended placings are now : first (2) MARCOOLA

                                                   second (5) TEMPORALE

                                                   third (1) HIGH GAIT

                                                   fourth (8) WILMA'S MATE

                                                   fifth (3) CYCLONE CHIEF

It is ordered that stakes be paid in accordance with the amended placings.

Facts:

Following the running of the BRECKON FARMS NORTHERN TROTTING DERBY an Information instigating a Protest was lodged by Stipendiary Steward Mr S Mulcay against the 5th placing of LEMOND on the grounds that it broke during the running and galloped in excess of 150 metres and thereby failed to promptly regain its proper gait.

Rule 870(3) requires: any horse that breaks during the running to promptly regain its proper gait.

The Breaking Horses Regulations provide: that any horse which gallops in excess of 150 metres during the running is in breach of Rule 870(3).

Mr CS Hunter the co-owner of LEMOND endorsed the Information WITH THE WORDS " I do not contest the Protest "

The Stewards demonstrated the incident by use of the Race films and showed where LEMOND went into a break on the first turn and it galloped well in excess of 150 metres.

Submissions for Decision:

Mr Mulcay submitted that LEMOND was in breach of Rule 870(3) and therefore it should be disqualified from the Race.
